End User License Agreement (EULA) for PastPaths¶
Version 1.0 — effective from 2026-05-20
By installing, copying, or using PastPaths (the "Software") you agree to these terms. If you do not agree to these terms, do not install or use the Software.
1. Parties¶
These terms constitute an agreement between you (the "User") and Maria Tingvall, contact address support@pastpaths.se.
2. The Software¶
PastPaths is a genealogy application that is installed and runs locally on the User's computer. All genealogical data, photos, and documents entered by the User are stored locally on the User's own equipment. The Software does not communicate with external servers beyond what is explicitly stated in the Software or in the Privacy Policy.
3. License granted to the User¶
I hereby grant the User a non-exclusive, non-transferable license to:
- Install and use the Software on the User's own computers
- Use the Software for private use
Private use means use by an individual or household for their own genealogical research. Use within a commercial business, educational institution, or association is also permitted in the current version. Should I in the future introduce a separate license for such use, it will apply to future versions only — not retroactively to versions already installed.
4. The User may not¶
- Sell, rent out, or redistribute the Software without my written permission
- Modify, decompile, reverse engineer, or attempt to extract source code from the Software
- Remove or obscure copyright or trademark notices
- Use the Software for unlawful purposes or in a manner that violates applicable law
5. The User's data¶
The User retains full ownership of all data entered into or imported to the Software, including personal data about relatives.
The User is responsible for:
- Ensuring that the data entered is lawful to process (particularly with regard to data about currently living persons under GDPR)
- Backing up their own data
- Informing affected persons to the extent required by law
See the Privacy Policy for more information.
6. Third-party components¶
The Software contains open-source components from third parties. A complete list of these and their licenses can be found in the file THIRD-PARTY-LICENSES.md that accompanies the Software.
7. Beta status¶
The current version of the Software is a beta version. This means that:
- The Software may contain bugs that have not yet been discovered or fixed
- Features may be changed, added, or removed in future versions
- The risk of data loss is higher than for a stable version
- The data model may change between versions, which may require migration of the database
Beta users are encouraged to:
- Be extra diligent about backups (see section 10)
- Not use the Software as the sole storage location for important genealogical data
- Report bugs and suggestions for improvement to support@pastpaths.se
8. No warranty¶
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. I DO NOT WARRANT THAT:
- The Software is free of errors or that errors will be corrected
- The Software meets the User's specific requirements or expectations
- The Software is compatible with all hardware or software
- Data cannot be lost or damaged during use, import, export, or update
9. Limitation of liability¶
To the extent permitted by law, I am not liable for any damages — direct, indirect, incidental, consequential, loss of data, loss of profit, or otherwise — arising from the use or inability to use the Software.
My total liability to the User under this agreement is limited to the amount the User has paid for the Software during the preceding twelve (12) months. For free-of-charge versions of the Software, liability is limited to zero (0) SEK.
10. Backup is the User's responsibility¶
Since the Software runs locally and all data is stored on the User's computer, the User is solely responsible for taking backups. I am not liable for data loss due to hardware failure, software failure, user error, or other causes.
Backup advice is available in the Software's documentation.
11. Updates¶
I may from time to time release updates to the Software. The Software does not automatically check for new versions — the User needs to visit pastpaths.se themselves to see if a newer version is available. Use of an updated version is governed by the then-current terms of use. The User is not obligated to update but is recommended to do so for security and functionality reasons.
12. Changes to these terms¶
I reserve the right to change these terms for future versions of the Software. The version of the terms in effect when the User downloaded the Software continues to apply to that version.
13. Termination¶
These terms remain in effect until terminated. The User may terminate use at any time by uninstalling the Software and deleting all copies. Upon termination, the User retains their own data.
I may revoke the license if the User breaches these terms. Upon revocation, the User shall uninstall the Software but retains their own data.
14. Governing law¶
This agreement is governed by Swedish law. Disputes shall primarily be resolved through dialogue between the parties.
For Users who are consumers, mandatory consumer protection legislation applies. This includes, among other things, the right to turn to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) and the right to bring proceedings before the court of the User's place of residence.
For Users who are not consumers, disputes shall be settled by a general court, with Örebro District Court (Örebro tingsrätt) as the court of first instance.
15. Other provisions¶
If a provision of this agreement is found to be invalid, this does not affect the remaining provisions. This agreement constitutes the entire agreement between the parties regarding the Software and supersedes all prior agreements.
